Newark ADU rules today (2026)

From January 1, 2027, state law (AB 956) requires cities, including Newark, to approve up to two detached ADUs on a lot with a single-family home. Newark adopted a new ADU ordinance in early 2026 (Ordinance 563), so its rules are recent. Here is how they line up with the new law.

  • Units allowed now: one ADU (detached or attached) plus one JADU (NMC §17.26.040, Ordinance 563, 2026). Under the state-exempt path, one conversion ADU, one JADU and one new detached ADU of 800 sq ft or less.
  • Sizes: detached up to 1,200 sq ft; attached up to 1,000 sq ft; conversions have no limit; JADU up to 500 sq ft. Garages and covered porches do not count as floor area.
  • Height: 16 ft for a detached ADU; 18 ft near transit or on lots with a multistory multifamily building, plus 2 ft for roof pitch in transit areas. Attached ADUs follow the district limit, up to two stories.
  • Setbacks: 4 ft side, rear and corner street-side. ADUs over 800 sq ft must meet the district front setback and landscaping rules.
  • Parking: none for an ADU or JADU, and no replacement parking.
  • Process: ministerial, no hearing, with a decision within 60 days of a complete application. Most ADUs need only a building permit.
  • Pre-approved plans: Ordinance 563 requires the city to post approved plans and designer contacts.

What changes on January 1, 2027

AB 956 raises the number of detached ADUs Newark must approve on a single-family lot from one to two, both new construction. Each may be limited to 800 sq ft of living space, local height limits can still apply, and side and rear setbacks can be no more than 4 ft. Where two detached ADUs are built, a JADU on the same lot does not have to be approved. The law also includes protections for owners in homeowners associations.

Newark already allows a detached ADU of 800 sq ft or less alongside a conversion ADU and a JADU. AB 956 adds a second new detached unit. Newark’s 1,200 sq ft detached limit is above the 800 sq ft each unit may be held to in a two-unit project. Units of 800 sq ft or less also have more front-setback flexibility under the current code. Newark will need to update its ordinance, and we will confirm the current rules as it does.

Planning two detached ADUs on a Newark lot

  • Design standards: detached ADUs match the house’s wall and roof colors, have no entrance or outside stairs on the street-facing front wall, use downward lighting and sit on a permanent foundation.
  • Privacy: second-story windows within 5 ft of a neighbor’s line must be obscured or have high sills, and second-story balconies are not allowed within 10 ft of the line. Second-story additions over 16 ft need design review.
  • Utilities: sewer is Union Sanitary District, water is Alameda County Water District and power is PG&E. Two units need a sewer and water layout that works for both.
  • Electrical: two ADUs usually need a load calculation and often a service upgrade.
  • Sprinklers: an ADU needs sprinklers only if the main house requires them.
  • Use and sale: rentals must be longer than 30 days, and separate sale is allowed only under Gov. Code §§66340–66341.
