Saratoga ADU rules today (2026)

From January 1, 2027, state law (AB 956) requires the City of Saratoga to approve up to two detached ADUs on a lot with a single-family home. Saratoga’s hillside lots and septic-served properties add review steps that matter for any backyard unit. Here is how the new law and the city’s current ADU rules fit together.

Saratoga’s ADU rules are in Zoning Article 15-56 (Ord. 376, 2020, amended by Ord. 399 and Ord. 405 in 2024).

  • Units allowed now: the city’s ADU code allows one ADU and up to two JADUs within the house or an existing accessory structure, plus one detached new-construction ADU.
  • Size: a detached ADU outside the setbacks may be up to 1,200 sq ft. An 800 sq ft unit with 4 ft setbacks is always allowed. An attached ADU is capped at 50% of the house, up to 1,200 sq ft. A JADU may be up to 500 sq ft. Basements and attics count as floor area.
  • Height: 16 ft detached, or 18 ft near transit, plus 2 ft for roof pitch.
  • Setbacks: 4 ft side and rear for a detached ADU; front per district, unless that blocks an 800 sq ft unit.
  • Parking: one space unless exempt, such as near transit or for a conversion. No replacement for a converted garage.
  • Process: Community Development decides ministerially within 60 days.

State review of Saratoga's ADU rules

In May 2023, the state housing department (HCD) found Saratoga’s 2020 ordinance out of compliance, citing a one-ADU-plus-JADU cap, height in setbacks, a bedroom cap and entrance rules. In December 2025 HCD sent a technical-assistance letter on deed restrictions, HOAs, JADU parking, completeness timelines and sprinklers. A city response was not found. Where local rules are stricter than state law, state law applies.

What changes on January 1, 2027

AB 956 requires the city to approve up to two detached new-construction ADUs on a single-family lot. The city may cap each at 800 sq ft of living space and apply height limits; side and rear setbacks can be no more than 4 ft. Where two detached ADUs are built, a JADU need not be approved, and HOA rules cannot block or unreasonably restrict the units. Saratoga allows one detached ADU today, so AB 956 adds a second. The city’s guaranteed 800 sq ft unit with 4 ft setbacks lines up with the new state size, while larger 1,200 sq ft units may not apply to the two-unit option. The city will need to update Article 15-56, and we confirm current rules as it does.

Planning two detached ADUs on a Saratoga lot

  • Hillside lots: the city may ask for a topographic map with contours at 5 ft or less, and a geologic report, to show there is no landslide hazard.
  • Septic: units served by septic need County Health approval. The owner records an agreement to connect to sewer when it becomes available.
  • Fire hazard zones: in very high fire hazard severity zones, setbacks must satisfy the fire agency.
  • Floor area: basements and attics count toward ADU size, so two units need careful planning.
  • Electrical: two units usually need a load calculation and often a service upgrade.
