Gilroy ADU Rules at a Glance
- A single-family lot can have an ADU plus a JADU; we confirm with Planning which combinations apply to your lot.
- Detached ADUs can be up to 1,000 sq ft. Attached ADUs can be 50% of the main home, but an 850 sq ft one-bedroom or 1,000 sq ft two-bedroom ADU is always allowed. JADUs can be up to 500 sq ft.
- Detached ADUs are limited to 16 ft (18 ft near transit, up to 20 ft to match the roof pitch); an ADU above a detached garage can be 24 ft.
- Side and rear setbacks are 4 ft. One parking space is required for a new ADU, with exemptions.
- Rentals must be at least 30 days, a deed restriction is recorded, and ADUs pay impact fees only at 750 sq ft or more.
- The pre-approved ADU program covers R1 and R2 lots with a single-family home, excluding hillside and Wildland-Urban Interface areas.
