New Homes in Hayward

RS zone basics: site plan review applies only when the Planning Director finds a project materially changes the property’s appearance. Homes are limited to 30 feet, rear-yard coverage to 40%, and additions over 50% of floor area or that add bedrooms must bring parking up to code. We talk to a planner about setbacks, coverage and guidelines before plan check.

Hayward Fault: the fault runs within a few hundred feet of Mission Boulevard. New construction in fault, liquefaction or landslide zones needs a licensed geotechnical engineer’s investigation, and occupied buildings cannot sit over an active fault, with a 50-foot setback unless the engineer recommends otherwise.

Submittal and Requirements

  • A single stamped PDF set with site, civil, floor, roof, MEP, elevations, sections, framing and foundation plans and Title 24.
  • Calculations and soils report as separate PDFs; trusses and solar as deferred submittals.
  • Two Level 2 EV-ready parking spaces per single-family home under the 2025 reach code.

Hayward Hills: grading must follow the Hillside Design Guidelines, grading on average slopes over 20% needs City Council approval with mailed notice within 300 feet, and the General Plan prohibits building on slopes over 25%. Hayward Fire reviews some hillside additions, and the wildland-urban interface area east of Mission and south of D Street, plus Fairview, requires wildfire-resistant construction.

Protected trees: trees 8 inches or more in diameter at 54 inches, and certain native species at 4 inches, need a removal permit.

Historic areas: changes to character-defining features of historic properties need a historical alteration permit, and demolition needs Planning Commission approval. Historic areas include the Upper B Street neighborhood, the B Street Streetcar District, Prospect Hill and Downtown, where Victorian and Queen Anne homes survive.
