  • A single-family lot can have an ADU plus a JADU, with more units where state law allows.
  • New attached ADUs can be up to 1,000 sq ft and 30 ft tall (or the zone limit); new detached ADUs up to 1,200 sq ft and 16 ft (18 ft near transit, plus 2 ft for roof pitch).
  • Side and rear setbacks are 4 ft. Detached ADUs generally need 10 ft from the main home.
  • No parking is required for an ADU, and converted garages need no replacement parking.
  • Rentals must be at least 30 days. JADUs can be up to 500 sq ft inside the home, including an attached garage.
  • ADUs are exempt from development impact fees. Fremont offers pre-approved detached ADU plans from about 496 to 1,000 sq ft with a 7-business-day review.
